Expert Legal Advice on Voluntary Transfers of Farmland | Tralee, Co. Kerry
Transferring farmland to the next generation is one of the most important decisions a farming family will make. A voluntary transfer of farmland requires careful planning to protect your family’s interests while considering legal, taxation and succession issues. At Whelehan Solicitors, we provide experienced legal advice on voluntary farm transfers for farmers and landowners throughout Tralee and County Kerry. We work closely with clients to ensure every transfer is completed efficiently and in accordance with Irish law.
Farm or Land Disposal
Transferring a farm to a family member, such as a child, requires careful planning. Before proceeding with any transfer, it’s essential to consult with a solicitor to explore the available options and identify the best solutions for your situation. Key considerations include:
- Future Income: Ensuring that you have sufficient income to support yourself and your family after the transfer.
- Farm Entitlements: Addressing the transfer of farm entitlements, such as single farm payments, rural environmental protection schemes (REPS), and milk quotas.
- Taxes: Understanding potential tax implications associated with the transfer. While we do not provide tax advice, we can guide you through the legal aspects and connect you with tax professionals if needed.
Young Trained Farmer Relief
The Young Trained Farmer Relief is designed to encourage the transfer of agricultural land to the next generation. This relief offers a zero rate of Stamp Duty to qualifying young farmers under specific conditions:
- Age and Qualifications: The “young trained farmer” must be under 35 years old and hold a qualification approved by Teagasc. This includes completion of a training course recognized by Teagasc or a qualification deemed equivalent by the National Qualifications Authority of Ireland.
- Commitment to Farming: The young farmer must commit to farming the land for at least 50% of their working time after the transfer.
- Land Sale Restrictions: The transferred land cannot be sold for five years unless replaced within one year of disposal.
For more information on Young Trained Farmer Relief, visit the Revenue Commissioners’ website.
Favorite Nephew/Niece Relief
This relief applies when a farm is transferred to a niece or nephew who has substantially worked on the farm. To qualify:
- Work Requirement: The niece or nephew must have worked on a full-time basis (typically at least 24 hours a week) for a period of at least 5 years. If the farm was operated only by the farmer, their spouse, and the niece/nephew, a minimum of 15 hours a week may suffice.
