Confidential Legal Advice for Domestic Violence Matters | Tralee, Co. Kerry
If you are experiencing domestic violence, coercive control or abuse, you do not have to face it alone. At Whelehan Solicitors, we provide confidential and compassionate legal advice to individuals throughout Tralee and County Kerry. We understand that every situation is different and can help you understand your legal rights, apply for the appropriate court orders and take steps to protect yourself and your family.
What counts as domestic violence?
Domestic violence is not only physical violence. It can include:
Threats, intimidation, harassment, or stalking
Coercive control (monitoring, isolating you, controlling money, restricting freedom)
Emotional, psychological, or verbal abuse
Sexual violence
Damage to property or threats to harm pets
Online abuse, tracking, or misuse of devices/accounts
If you’re unsure whether your situation “qualifies”, speak with a solicitor — you can still take steps to protect yourself.
Urgent legal protection in Ireland
Depending on your circumstances, the court may grant one or more of the following:
Protection Order
A short-term order that can be granted quickly while a Safety Order or Barring Order application is being considered.
Safety Order
Protects you from violence or threats of violence. It may include conditions preventing intimidation or harassment.
Barring Order
Requires the other person to leave the home and stay away for a period set by the court.
Interim Barring Order
An urgent, temporary barring order (short-term) where the court considers there is an immediate risk.
We will explain which option fits your situation and help you apply as quickly as possible.
Who can apply for an order?
You may be able to apply if the abusive person is:
Your spouse or civil partner
A current or former partner (including cohabiting partners)
A parent of your child
A family member or someone you live with (in certain situations)
Eligibility can depend on your relationship, living arrangements, and the type of order sought. We’ll guide you clearly through this.
What happens in court?
Most applications are made through the District Court (and in some cases the Circuit Court). The process typically involves:
Initial consultation (confidential) to understand the risk and the quickest route
Preparing your application and sworn documents
Court hearing (and sometimes an urgent hearing for immediate protection)
Service of the order and next steps if there is a breach
We keep the process as straightforward as possible and focus on your safety and peace of mind.
If children are involved
Where children are at risk, the court can make additional directions. We can also advise on:
Guardianship, custody, and access arrangements
Urgent applications where safety is a concern
Communication boundaries and safe handovers
Next steps following separation
Your child’s welfare is always central.
What to bring (if you can)
If it’s safe to do so, it can help to gather:
A written timeline of incidents (dates, what happened, witnesses)
Screenshots/messages/voicemails
Photos of injuries or property damage
Garda information (if any)
Medical notes (if any)
If you have nothing documented — that does not mean you can’t take action. Talk to us anyway.
